But one person isn’t so happy with the picture: Spencer Elden, the baby in the picture. Thirty years later, Spencer wants compensation from the band ‘Permanent damage left’.

 

“He has extreme and permanent emotional problems”

 

In 1991 Nirvana ‘s album Nevermind was released, including the monster hit ‘Smells Like Teen Spirit’. The cover of the record is just as iconic, but Spencer, the baby in the pool on the cover, doesn’t like it. The now 30-year-old is now suing Nirvana for sexual exploitation of children, according to court papers held by TMZ . This shows that Spencer believes that the photo is child porn and that he was never able to give permission for the use of the image, as he was only 4 months old at the time.

In addition, Spencer claims that he was promised to cover his genitals with a sticker, but that never happened. “It left him with permanent damage,” Spencer’s attorney said. He has extreme and permanent emotional problems, a lifelong loss of income capacity and loss of joy in life. In his claim, Spencer demands 130 thousand euros from the living members of Nirvana, the photographer Kirk Weddle and the band’s record labels.

Spencer also says that his parents only received $200 at the time of the shoot, but nothing more. Also, there would be no contractual agreement for the use of the image. It comes as a surprise to fans of Nirvana and the album Nevermind. Spencer recreated the photo on his 10th, 17th, 20th and 25th birthdays.
